Legacy Planning

Our approach is educational and proactive – we educate you based on the specifics of your family situation, your assets, and your individual needs, wants, desires and values and then guide you to tell us what you want most, so we can create the plan (and the fee for that plan) that aligns with your objectives for your family and your assets.

How We Work

We believe in personalized service for each and every client. Our approach is educational and proactive – we educate you based on the specifics of your family situation, your assets, and your individual needs, wants, desires and values and then guide you to tell us what you want most, so we can create the plan (and the fee for that plan) that aligns with your objectives for your family and your assets.

Our estate planning process begins with a 2-hour Life & Legacy Planning Session. This is a legal tax and planning session with Attorney Elizabeth Joiner so you can learn how to plan for and protect your family and assets with an estate plan that works when your family needs it - with the goal of keeping them out of court and out of conflict.

After the Life & Legacy Planning Session, we draft your plan consistent with your personal goals, values and relationship dynamics. Then, Attorney Elizabeth Joiner meets with you again to review your design and confirm your decisions. Once your plan is finalized, our Client Services Director conducts a virtual Signing Ceremony with you, followed by a Binder Delivery Meeting. The whole process generally takes 8 weeks.

What to Expect During Your Life & Legacy Planning Session

The purpose of the Life & Legacy Planning Session is to help you get your financial life well-organized, clarify what you have and what you’ll need to ensure you live life responsibly and your loved one’s feel well led and well loved.

You will get the most out of your personal Life & Legacy Planning Session if you are prepared. Therefore, in order to assist you with designing a plan that meets your goals and addresses your concerns, we need to know about you and your family. When you register for a Life & Legacy Planning Session,  you will be sent a Family Wealth Inventory and Assessment, which will need to be returned to us at least 3 days before your meeting, so you will feel more clear than you ever have before about what to do to ensure your family has everything they need for the rest of your life and beyond.

"If you commit to completing the online questionnaire (homework) before our planning session so we can advise you based on your unique family values, dynamics and assets and if you are married and planning jointly, both spouses are in attendance, then we waive the $750.00 Life & Legacy Planning Session Fee. "

Complete the worksheet as best you can. Don’t worry if you don’t know all the details we've asked for, it’s a great starting point for you to get your affairs organized. We realize that for many people this is a starting point.

Here's what will happen during the Session:

  • You'll share your family dynamics and assets and we’ll explain the law and how it will apply from a legal and tax perspective;
  • You’ll share with us whether you want anything to be different for yourself and the people you love, and if so, we help you choose among our planning package options so you get the most efficient, effective plan at your budget … and you choose your own fee
  • If we decide we are a good fit to work together, we'll review our planning process and how we’ll keep you moving forward over the next 4-8 weeks (and if we aren’t fit, we’ll make recommendations for you to find the right fit for you)

We Offer 3 Levels of Planning

We believe that estate planning is not one size fits all. Therefore, we offer 3 levels of planning to suit your varying needs. From starter plans primarily for families with young children and little in the way of financial wealth to more robust plans for well-established families concerned with matters of asset protection, preservation and increased growth, we’ve got you covered

Family Plan

For The Family Who . . .

Doesn’t have assets that would have to go through the court process called probate, but who want a say in how their minor children are cared for, their health care wishes turned into directives and their loved ones to be able to access their assets using a durable power of attorney if they become incapacitated.

Business Plan

For The Family Who . . .

Owns a family business and wants assurance that their business legacy will be protected in the event of their death.

Clients choosing this Plan receive all the benefits from the Family Plan and Trust Plan, while also receiving succession planning for the business they have worked so hard to build.

Trust Plan

For The Family Who . . .

Wants the assurance and peace of mind of knowing Family Wealth will be transferred to heirs with the most ease and convenience possible in the privacy of our office without court involvement.

Clients choosing the Trust Plan may also opt to protect their beneficiary’s inheritance from lawsuits, spouses, and estate taxes.

We’ve priced our planning for you at the intersection of affordability and effectiveness. When we meet for your Life and Legacy Planning Session, we will review the 3 planning levels with you, and you will choose your own fee based on your budget and the planning options that are most important to you and your family. Our plans are focused on putting a plan in place so that your family has somewhere to turn if and when something happens to you, that your plan will work and you have real security, not the false security that comes with a cheap set of estate planning documents.

There truly is no one size fits all choice. We have created a process, though, to educate you quickly and effectively so that you can make empowered, informed choices about what you want for the people you love, so that you aren’t simply choosing the cheapest option because you don’t have any other basis for making your decisions.

Frequently Asked Questions About Our Process

  • How much is the Life & Legacy Planning Session?

The Life & Legacy Planning Session is a 2-hour legal tax and planning session. It is a working meeting valued at $750 (or $950 if you have an estate plan you want reviewed). However, if you commit to completing the homework ahead of time and, if married and planning jointly, both spouses are in attendance, then we WAIVE the Session Fee.

  • How much is a comprehensive estate plan?

This is the most often asked question in estate planning, and that is okay – we know the topic of cost is a sensitive one when it comes to choosing a professional to guide you, and we have designed our fees on a flat-fee basis only so that you know exactly what you are committing to – and there are no surprises. During the Life & Legacy Planning Session you will choose your fee based on the level of asset protection you would like to leave your family. If you are a business owner and complete business succession planning at the same time as your personal estate planning, fees may be considered a business expense (and, therefore, a business deduction). • Do you offer financing?

Yes! We can break payment into multiple payments as an interest-free financing option. We also accept financed payments through LawPay.

  • What if I move?

Your estate plan works no matter where in the U.S. you might physically be (such as on vacation) or might move to. This said, we recommend contacting us to help find an attorney to review your out-of-state plan to help you ensure you make any necessary updates based on differences in state law.

  • What kind of families do you help?

For legacy planning, we represent Florida families throughout varying stages of life:

    • two parent families or single parents wishing to provide for and protect their children and themselves;
    • unmarried couples who are either solidifying their relationship through proper planning or dissolving their relationship with the assistance of caring counsel,
    • blended families negotiating the challenges of creating new relationships with varying expectations
    • families with special needs looking to ensure that their children with special needs will be taken care of and able to continue to receive government assistance
    • high net worth families seeking strategies for minimizing estate and income taxes
    • family business owners seeking ways to protect and expand their companies and considering how and when to transition to the next generation of ownership
  • I already have a plan in place, do I still need to schedule a Life & Legacy Planning Session?

If you already have a Will, Trust, Health Care Directives and/or a Power of Attorney in place, you may think you don't need to come in for a Life & Legacy Planning Session. Here's why you do, though. Estate planning documents by themselves are meaningless to your family if they are not kept up to date throughout your lifetime and if your assets are not owned in the right way to keep your family out of Court and out of conflict, when something happens to you. If there have been any changes in your life, the law or your assets since you put in place those documents and the documents have not been updated, come on in so we can make sure your plan still serves you and your family. And, if you have minor children at home, there is a very good chance that the documents were not prepared with the best protections for them in the first place. That means your children could be at risk of being in the care of someone you would not want. Sadly, most lawyers simply do not have the knowledge, training or experience to plan properly for the care of minor children. Not to worry though ... we'll discuss how to fix that when you come in.

  • I don't think I have enough assets for an estate plan, should I schedule a Session?

Yes! Estate planning is much more than looking assets - it is protecting overall Family Wealth, which you have no matter how much or how little financial wealth you have. Family Wealth, which we will be discussing during our Planning Session goes far beyond your money. It covers everything you create in your life and pass on when you are gone.  No matter what, your family will have to make hard decisions, pay your bills, get access to your home and vehicle and social media accounts, when something happens to you. This can be easy for them during a time of extreme grief, or hard. What you do now is what determines how hard or how easeful it will be.

And, if you have dependent children at home, planning is a must. You would never think of leaving your young kids or teens at home for an extended period with the one person you would never want, so why would you leave that to chance for a substantial part of their lives, if something happens to you. The Life & Legacy Planning Session is designed to take an honest look at what you really do need in place to provide for the well-being and care and ease of the people you love the most.

  • What if after the Session I decide I don't need any planning? Do I still get charged?

If the $750 (or $950) fee was waived because you 1) turned in your homework and 2) everyone involved attended, then you still don't pay anything! If it turns out you don't need any planning at all beyond the Session, you leave the Session educated, informed and feeling great that you have done the right thing by your family by investigating what's necessary to make things as easy as possible for them at the end of your life. Plus, most people who go through the Life & Legacy Planning Session say that they’ve never felt more organized or at ease about their financial life than after experiencing the same process.
